Patrimony Moral Extension

Abstract

The author understands that, the patrimony, like a personality attribute, includes all the personal rights, without excluding qualifi ed like morals. It is necessary to “correct” the civil norms according with a harmony with the juridical system and, especially, with our Constitution. It is fundamental to conceive as part of the persons patrimony its moral area, since this one can be damaged and it gives right to repair. The author does not agree with that vision that considers that any pecuniary repair that should recognize a moral hurt, in last term, would bring an enrichment of the person who assumes the paper of victim sympathetic on indemnifi cation, with which there gets lost the sense of repair that is own to this modality of presentations. The author to establish if his disagreement recognizes or not some worthy foundation, checks some concepts concerning the patrimony of the person and its content.
