Women as (possible) author of a rape
Abstract
This paper examines the recent doctrinal discussion generated
in the national sphere regarding the possibility that a woman
can be charged as the perpetrator of the crime of rape. To do
this, first it determines which place this figure occupies in the system
of crimes related to sexual behavior. It then analyzes the content of
the typical action of crime, taking account of their relevance to the problem analyzed and developing different thesis that have been outlined on the matter, finishing with the articulation of interpretative variants about the eventual active subject in relation to the three traditional forms of authorship: (i) directly or executive responsibility; (ii) indirect perpetration, and; (iii) co-authorship.
